1. Acceptance of Terms
By registering, accessing, or subscribing to KonXPro ("Service," "Platform"), operated by KonXPro ("Company," "we," "us"), you agree to be bound by these Terms of Service ("Terms"). If you are entering into these Terms on behalf of a company, partnership, or trade organization, you represent that you hold legal authority to bind that entity.
2. Eligibility & Account Registration
The Service is intended solely for licensed trade contractors, construction professionals, expediters, and commercial entities operating in the State of New York and surrounding metropolitan regions. You agree to provide accurate, current, and complete registration data and safeguard account credentials.
3. Service Description & Subscriptions
KonXPro provides a cloud-based intelligence platform ingesting and categorizing building permit records, violation notifications, and owner contact intelligence across Manhattan, Brooklyn, Queens, Bronx, and Staten Island. Services are billed on a flat recurring monthly subscription basis according to your chosen plan tier.
4. NYC Department of Buildings (DOB) Public Records Disclaimer
EXPLICIT PUBLIC RECORD NOTICE: All building permits, job applications, violations, estimated job costs, contractor filings, and property owner identifiers displayed on KonXPro originate from public records published by the City of New York and the NYC Department of Buildings ("NYC DOB"). KonXPro does not verify, warrant, or guarantee the accuracy, completeness, or timeliness of official municipal records. KonXPro is an independent SaaS intelligence service and is NOT affiliated with, sponsored by, or endorsed by the City of New York or any governmental agency.
5. Subscription Billing, Free Trials & Cancellation
Subscriptions renew automatically on a monthly basis until canceled. If you sign up under a 14-day free trial, you may cancel anytime prior to the trial conclusion without charge via the Customer Billing Portal. Subscription fees are processed securely via Stripe. Paid subscription charges are non-refundable except where required by applicable law.
6. Acceptable Use & Lead Outreach Standards
Subscribers agree to utilize owner contact records and permit leads in full compliance with applicable federal, state, and local laws, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and NYC DCA/DOB home improvement contractor solicitation rules. Automated robotic harassment or unlawful marketing is strictly prohibited.
7. Intellectual Property & Limited License
KonXPro retains all ownership rights, trademarks, UI architecture, algorithms, and derivative database schema. Subscribers receive a non-exclusive, non-transferable, revocable license to query, view, and export permit dossiers solely for internal trade business development.
8. Third-Party Integrations & External Data
The Service integrates with third-party providers, including Stripe for payment processing and Leaflet/OpenStreetMap for mapping. We are not liable for outages, alterations, or disruptions originating from third-party vendor platforms.
9. Confidentiality & Security
You agree to preserve the confidentiality of your account credentials and immediately notify KonXPro of any suspected unauthorized access or breach of security.
10. Warranty Disclaimer
THE SERVICE AND ALL PERMIT DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY OF PUBLIC RECORDS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KONXPRO AND ITS DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST CONTRACT PROFITS. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless KonXPro from and against any claims, liabilities, damages, and expenses arising out of your misuse of the platform, violation of these Terms, or any unlawful outreach or communications directed at property owners.
13. Dispute Resolution & Mandatory Binding Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms or the breach thereof shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. You agree that any claim must be brought in your individual capacity, and not as a plaintiff or class member in any purported class proceeding.
14. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any legal proceedings not subject to arbitration shall be submitted to the exclusive jurisdiction of the state and federal courts located in New York County, New York.
15. Term & Termination
We reserve the right to suspend or terminate accounts that violate acceptable use standards, engage in scraping, or fail to pay subscription dues upon notice.
